Fraud Offences

Criminal Law

Fraud (dolandırıcılık) is one of the offences dealt with under criminal law. It arises when people are deceived by fraudulent conduct and suffer financial or legal harm as a result. With the development of technology, fraud methods have also diversified, and new methods carried out over the internet, by telephone, on social media and through digital platforms have emerged.

In fraud cases, the process must be assessed correctly from a legal point of view, both so that victims can protect their rights and so that persons accused of the offence can put forward an effective defence.

How Is the Offence of Fraud Committed?

At the core of the offence of fraud is a person influencing the other party through misleading conduct and obtaining an unjust benefit. However, not every deceptive act automatically constitutes the offence of fraud. The nature of the incident, the method used, the relationship between the parties and the resulting harm must be assessed together.

In criminal proceedings, the following elements are particularly important:

  • whether there was fraudulent conduct,
  • whether the victim suffered harm because of that conduct,
  • whether the perpetrator obtained an unjust benefit.

Fraud Methods Encountered Today

Today, fraud offences can be committed not only by traditional methods but also by using digital tools. For this reason, every incident has its own particular features.

Types of fraud frequently encountered in practice include:

  • online shopping fraud,
  • fake websites or fake listings,
  • bank and payment system fraud,
  • fraud committed by telephone,
  • fraud committed via social media,
  • investment and financial fraud.

Fraud on the Internet and in the Digital Environment

As technology has become widespread, fraud offences have also moved into the digital environment. Fake accounts, identity impersonation, fake sales listings and methods that abuse a relationship of trust are among the types of fraud frequently encountered online.

In such cases, digital records, bank transactions, contact details and electronic data can be important evidence for the investigation.

What Should Victims of Fraud Do?

For people who have suffered harm through fraud, it is important first to preserve the available evidence and to start the legal process correctly.

Messages, bank receipts, payment records, website information, telephone records and other digital data can play an important role in clarifying the incident.

Conducting the process correctly matters for identifying the perpetrator, establishing the harm and protecting the rights of the victim.

Aggravated Fraud Offences

Some acts of fraud may lead to more serious legal consequences because of the method used or the features of the incident. In particular, circumstances such as the use of technological tools, or the use of public institutions or certain professional groups as a means, may be significant in the legal assessment of aggravated fraud (nitelikli dolandırıcılık).

In such files, the incident must be examined in detail and it must be determined under which provision the offence will be assessed.

The Defence Process in Fraud Accusations

For persons facing a fraud allegation, too, the file must be assessed in all its aspects. A complaint or allegation does not, on its own, mean that an offence has been committed.

In the defence process, the legal position should be established by assessing together how the incident occurred, the relationship between the parties, the element of intent and the available evidence.

The Importance of Evidence in Fraud Files

Evidence is decisive in fraud investigations and trials. Bank records, messages, electronic data, camera footage and witness statements can all affect how the file is assessed.

However, evidence must be obtained lawfully and interpreted correctly. An electronic record or an allegation may not, on its own, lead to a definitive result.

Fraud files are not only about establishing the financial loss. How the incident occurred, the intentions of the parties, the method used and the legal consequences must be assessed together.

For this reason, the legal steps taken from the start of the investigation (soruşturma) through to the trial stage are important steps that can affect the outcome of the process.
