KVKK Compliance Process
In an increasingly digital business world, companies process a large amount of personal data belonging to their customers, employees, suppliers and users. Collecting, using, storing and protecting this data lawfully is no longer just a technical matter; it is also an important legal obligation.
The KVKK compliance process is a comprehensive legal and organisational exercise carried out to bring a business’s data processing activities into line with the Law on the Protection of Personal Data No. 6698 (KVKK).
This process is not limited to preparing a few legal texts. It requires identifying which data the company processes, analysing data flows, organising employee processes, assessing technical security measures and building a sustainable data management system.
Why Is a KVKK Compliance Process Necessary?
Personal data has become one of companies’ most important assets today. However, collecting this data without control or using it for other purposes may both violate people’s rights and lead to serious legal consequences for businesses.
The main purpose of the KVKK compliance process is not only to avoid administrative sanctions. The real purpose is to ensure that personal data is managed securely, transparently and lawfully.
The Personal Data Protection Authority (Kişisel Verileri Koruma Kurumu) also states that compliance work must be carried out systematically so that data controllers (veri sorumluları) can fulfil their obligations under the Law.
How Do You Start a KVKK Compliance Process?
The first stage of KVKK compliance work is analysing the company’s current situation. A proper compliance process cannot be built without establishing which personal data the business collects, for what purposes it uses that data, with whom it shares it and how long it stores it.
For this reason, the company’s data processing map is drawn up first and the life cycle of personal data is examined.
For each item of personal data, points such as the following are assessed:
- How it was obtained,
- For what purpose it is processed,
- Who can access it,
- To whom it may be transferred,
- How long it will be stored.
Creating a Personal Data Inventory
The personal data inventory (kişisel veri envanteri) is the foundation of the KVKK compliance process. A data inventory is a comprehensive study that shows in which areas the business processes personal data.
Customer information, employee records, camera footage, website data, marketing records and supplier information within the company are each assessed separately.
A correctly prepared data inventory helps both with drafting the legal texts and with bringing the company’s data management processes under control.
Legal Analysis of Data Processing Activities
In the KVKK compliance process, it is examined not only which data is processed but also on which legal basis the processing relies.
Explicit consent (açık rıza) is not required for every personal data processing activity. In some cases, legal grounds such as legal obligations, the conclusion of a contract or legitimate interest may apply.
For this reason, companies collecting unnecessary explicit consent, or failing to establish a proper legal basis where one is needed, may create risk.
Legal Texts to Be Prepared Under the KVKK
One of the important stages of the compliance process is preparing legal documents suited to the company’s activities.
Since every business has a different data processing structure, using ready-made, generic texts directly does not always provide sufficient legal protection.
The main texts that may be needed under the KVKK include:
- Privacy notices
- Explicit consent processes
- Personal data retention and destruction policies
- Confidentiality procedures
- Employee data policies.
KVKK Compliance in Employee Processes
For businesses, employee data is one of the important parts of the KVKK compliance process.
Personal data is processed at many stages, from recruitment to keeping employee files, and from performance reviews to the termination of employment.
For this reason, human resources processes must be brought into line with the KVKK in order to protect employee data.
For more detailed information, see the Employee Data Protection page.
Taking Technical and Administrative Measures
KVKK compliance cannot be achieved through legal documents alone. Companies must take technical and administrative measures to ensure the security of personal data.
In this context, practices such as the following are assessed:
- Authorisation controls,
- Access restrictions,
- Encryption methods,
- Backup processes,
- Staff awareness training.
KVKK Compliance of Websites and Digital Platforms
Today, many companies collect personal data through websites, mobile applications and digital platforms.
Contact forms, membership systems, e-commerce infrastructure, analytics tools and advertising technologies should be assessed under the KVKK.
In this context, the following should be examined from a legal point of view:
- Cookie use,
- Website forms,
- User registration processes,
- Digital marketing practices.

VERBİS and the KVKK Compliance Process
Data controllers that meet certain conditions are under an obligation to register with the Data Controllers’ Registry Information System (VERBİS).
In the VERBİS process, the company’s data processing activities, data categories, purposes, retention periods and transfer details are notified to the system in the proper way.
VERBİS registration on its own does not mean that KVKK compliance is complete. What really matters is that the company applies data protection principles in its daily activities.

Preparing for Data Breaches
A data breach may occur when personal data is lost, obtained by unauthorised persons or shared unlawfully.
Companies need to decide in advance how they will act in such situations.
Setting up processes to detect and assess a data breach, make the required notifications and prevent it from happening again is an important part of KVKK compliance work.
KVKK Compliance Is Not a One-Off Exercise
Personal data protection processes are dynamic and need to be updated as the company’s activities change.
When new employees are hired, new software is used, different marketing methods are adopted or new data collection channels are created, KVKK processes need to be reassessed.
Building Secure Data Management for Companies
The KVKK compliance process is a comprehensive exercise that increases businesses’ legal certainty and supports the trust of customers and employees.
With a well-planned compliance process, companies can manage personal data in a more controlled way, reduce their legal risks and build a more trustworthy structure in the digital world.
