Notice Pay
Terminating an employment contract has various legal consequences for both the employee and the employer. The law provides for certain notice periods so that neither party suffers because the employment relationship ends suddenly.
Notice pay (ihbar tazminatı) is a type of compensation that arises when the party wishing to terminate the employment contract does not comply with the notice period set out in the law. It is one of the important employment law institutions that aim to protect the parties financially when the employment relationship is brought to an end.
What Is Notice Pay?
Notice pay is the amount that must be paid if the statutory notice period is not observed when the employee or the employer terminates an employment contract of indefinite duration.
The aim is to inform the other party in advance that the employment contract will end, so that they can prepare for the new situation. In terminations made without observing the notice period, an obligation to pay notice pay may arise.
How Is the Notice Period Determined?
The notice period varies according to the employee’s length of service. Under Labour Law No. 4857 (İş Kanunu), different notice periods apply depending on the employee’s seniority.
As the length of service increases, so does the notice period that the employer or the employee must observe. Calculating these periods correctly is important for determining the amount of notice pay.
When Does Notice Pay Arise?
Notice pay generally arises when the employer dismisses the employee without observing the notice period, or when the employee ends the employment contract in breach of the notice period.
However, notice pay does not arise in every case of leaving or termination. The type of employment contract, the reason for termination and the conduct of the parties must be assessed together.
Can the Employer Dismiss an Employee Without Giving Notice?
In some cases, the employer can end the employment contract immediately. However, this requires the just causes or special conditions set out in the law.
In terminations made without just cause and without observing the notice period, the employee may become entitled to claim notice pay.
Can an Employee Who Resigns Receive Notice Pay?
Whether an employee who leaves voluntarily can receive notice pay depends on the reason for leaving and the way the contract was terminated.
Under normal circumstances, an employee who resigns has no right to notice pay. However, unlawful practices by the employer, grounds for termination for just cause or special circumstances can lead to different legal results.
How Is Notice Pay Calculated?
Notice pay is calculated on the basis of the employee’s gross wage on the date of termination and the statutory notice period. The calculation may need to take into account not only the basic wage but also certain regular and continuous fringe benefits.
Whether items such as transport, meals, bonuses and other regular payments are included in the calculation is assessed according to the specific working conditions.
The Difference Between Notice Pay and Severance Pay
Although severance pay and notice pay are often mentioned together in practice, their legal nature is different.
Severance pay (kıdem tazminatı) is a right that an employee who meets certain conditions acquires on the basis of their length of service, whereas notice pay is compensation arising from failure to observe the notice period.
In some terminations, the employee may be entitled to both severance pay and notice pay, while in other cases only certain rights may arise.
Notice Pay in the Case of Termination for Just Cause
Termination for just cause (haklı nedenle fesih) is a special type of termination that allows the employment contract to be ended immediately. Since no notice period applies in a termination for just cause, the results with regard to notice pay are different.
It is therefore necessary to assess correctly whether the reason for termination really constitutes just cause.
The Lawsuit Process in Notice Pay Disputes
If the employee and the employer disagree about notice pay, legal remedies may become relevant.
In employment disputes, there are cases where the mandatory mediation (zorunlu arabuluculuk) process must be completed before a lawsuit is filed. If no agreement is reached at the mediation stage, the process can continue with a lawsuit in the labour courts.
The Importance of Documents in Notice Pay Claims
In notice pay disputes, the employment contract, wage records, payslips, the termination notice, the length of service and the correspondence between the parties are among the important pieces of evidence.
In particular, establishing correctly how the contract was terminated and what the parties intended can be decisive in resolving the dispute.
You can calculate your notice pay together with your severance pay using the severance and notice pay calculator.
Protecting Your Rights When an Employment Contract Ends
Notice pay is not just a payment item that arises when someone leaves a job. It is also the legal consequence of the conditions under which the employment relationship ended.
Correctly assessing the parties’ obligations during the termination process is important both to prevent the employee from losing rights and to avoid disputes that the employer might face in the future.
