Removal of Objection

Enforcement and Debt Recovery

The debtor’s objection to enforcement proceedings is an important stage that directly affects the creditor’s process of collecting the claim. One of the legal remedies available to the creditor where proceedings have been halted by the debtor’s objection is the removal of the objection (itirazın kaldırılması).

The removal of the objection is a special legal process that allows the objection to enforcement proceedings to be removed by the enforcement court (icra hukuk mahkemesi), provided that certain conditions are met and documents of the kind specified in the law are available.

This route is not a general method that can be applied in all enforcement proceedings. For the objection to be removed, the basis of the proceedings and the documents submitted must meet the legal requirements.

What Is the Removal of the Objection?

In enforcement proceedings without a judgment (ilamsız icra takibi), the proceedings stop when the debtor objects to the payment order (ödeme emri). In some cases, the creditor may have to apply to the court for the halted proceedings to continue.

The removal of the objection is a more specialised enforcement law remedy available to the creditor when the creditor holds a document of a kind accepted by the law. In this process, rather than examining the whole dispute from beginning to end as in an ordinary debt lawsuit, the enforcement court makes its assessment mainly on the basis of the nature of the document submitted and the legal validity of the objection.

Which Court Hears the Removal of the Objection?

Requests for the removal of the objection are examined by the enforcement courts. In this respect, it differs from the action to annul the objection (itirazın iptali davası).

While the action to annul the objection is a lawsuit filed in the ordinary courts, the removal of the objection is a special enforcement law application aimed at allowing the enforcement proceedings to continue.

Final Removal of the Objection

Final removal of the objection (kesin kaldırma) can be requested if the creditor holds a conclusive document of the kind specified in the law.

In particular, documents whose signature has been admitted or which have been drawn up by a notary, documents containing an acknowledgement of debt and other documents meeting certain conditions can be important in this process.

If, following the court’s examination, the debtor’s objection is found to be unjustified, the objection can be removed and the court can order the enforcement proceedings to continue.

Provisional Removal of the Objection

In some cases, the creditor’s document may not be sufficient for final removal of the objection but may still meet the conditions set out in the law. Provisional removal (geçici kaldırma) may become relevant especially where there are objections to the signature.

At this stage, the decision is made by assessing the debtor’s claims, the examination of the signature and the relevant documents.

Which Documents Are Required for the Removal of the Objection?

The most important issue in the removal of the objection is the legal nature of the document held by the creditor. Not every written document is considered sufficient for the removal of the objection.

The document on which the proceedings are based must:

clearly show the debt, be valid in terms of its signature or the way it was drawn up, and meet the requirements of the law.

For this reason, it is very important to assess correctly the legal nature of the documents used when starting the proceedings.

The Debtor’s Grounds for Objection

The debtor can object to enforcement proceedings for various reasons. The debtor may claim that the debt does not exist, that it has been paid, that the signature is not theirs, or that the proceedings are unlawful.

In the removal of the objection process, the defences put forward by the debtor and the available documents are also assessed by the court.

The Difference Between the Removal of the Objection and the Action to Annul the Objection

These two legal remedies are often confused in practice. However, they differ significantly in their purpose and in the method of examination.

The removal of the objection stands out mainly as a fast remedy for claims proved by certain documents. In an action to annul the objection, by contrast, the existence of the claim is examined more comprehensively by the ordinary court.

Which route to choose should be decided according to the nature of the claim and the state of the available documents.

What Happens After the Objection Is Removed?

If the court decides to remove the objection, the enforcement proceedings can continue from where they stopped. The creditor can continue the enforcement steps and take the necessary action to collect the claim.

However, the process does not end with the court’s decision. The enforcement steps taken after the decision must also be carried out in accordance with the procedure.

The Importance of Document Management in Enforcement

In enforcement law, documents are often one of the key factors that determine the outcome of the process. What matters is not only the existence of a claim, but also which document supports it and with what legal force.

For this reason, preparing contracts, payment documents and documents containing an acknowledgement of debt correctly in commercial relationships provides a significant advantage in disputes that may arise later.

Points to Consider in the Removal of the Objection Process

The removal of the objection is a technical enforcement law procedure in which time limits and procedural rules are important. The suitability of the creditor’s document, the timing of the application and the steps taken in the enforcement file must be assessed together.

Determining the right legal route is important for avoiding unnecessary proceedings and for pursuing the claim effectively.
