Renunciation of Inheritance

Inheritance Law

An inheritance does not consist only of the assets of the deceased. Some of the debts and obligations of the deceased may also pass to the heirs. For this reason, heirs are not obliged to accept the inheritance left to them.

Renunciation of inheritance (mirasın reddi), also known as “reddi miras”, is the heir’s declaration that they do not accept the inheritance that passed to them on the death of the deceased, and their avoidance of the rights and obligations arising from being an heir.

Especially where the debts of the deceased exceed their assets, renunciation of inheritance provides an important legal option for protecting the heirs financially.

What Is Renunciation of Inheritance?

Renunciation of inheritance is the heir’s use of the right not to accept the inheritance left to them. Under the Turkish Civil Code (TMK), heirs can exercise this right within certain time limits and procedures.

With the renunciation of the inheritance, the heir not only has no rights over the assets of the deceased but may also be released from liability for the debts of the estate.

However, renouncing an inheritance is not a simple step taken only to “avoid debts”. It is an important inheritance law transaction whose time limits and legal consequences may affect the position of the other heirs.

When Does Renunciation of Inheritance Arise?

Renunciation of inheritance is usually chosen where the deceased had substantial debts. In particular, where there are loan debts, tax debts, enforcement proceedings or other debts owed to third parties, the heirs may have to consider whether or not to accept the inheritance.

At the same time, some people may not want to accept the inheritance for personal or family reasons relating to the deceased.

In every case, what matters is that the true state of the inheritance is analysed correctly and that the decision is made with knowledge of its legal consequences.

What Is the Time Limit for Renunciation of Inheritance?

The right to renounce an inheritance must be exercised within a certain period. Under the Turkish Civil Code, for statutory heirs this period is three months from the date on which they learned of the death of the deceased and that they are an heir.

Since this is a strict time limit (hak düşürücü süre), if the necessary application is not made within the period, the inheritance may be deemed to have been accepted.

For this reason, after the death of the deceased, not only their assets but also their debts need to be investigated, and the decision must be made in time.

How Is an Inheritance Renounced?

Renunciation of inheritance is made by the heir’s declaration, given orally or in writing, to the civil court of peace (sulh hukuk mahkemesi) (Turkish Civil Code (TMK) Art. 609). The declaration must be unconditional and without reservation; a statement made outside the court, for example before a notary or to the other heirs, does not count as a renunciation.

The competent court is the civil court of peace at the deceased’s last place of residence.

Unlike a contested lawsuit, the procedure before the court consists of taking the heir’s declaration and creating the necessary records.

Is a Lawsuit Needed to Renounce an Inheritance?

Renunciation of inheritance is not always conducted as a lawsuit in the traditional sense. The essential point is that the heir applies to the civil court of peace within the statutory period and makes a declaration of renunciation.

However, in some cases disputes relating to renunciation may arise. Different legal processes may come into play, particularly where the time limit has been missed, where it is claimed that the inheritance was accepted, or where the heirs are in disagreement with one another.

Does Renunciation Release You from the Debts?

If the inheritance is renounced in the proper way, the heir is, as a rule, not liable for the debts of the deceased.

However, for this the renunciation must be made within the time limit and in accordance with the law. Missing the deadline or acting in a way that shows the inheritance has been accepted may lead to different legal consequences.

It is particularly important for people who have no information about the debts of the deceased to obtain a legal assessment before making a hasty decision.

Being Deemed to Have Accepted the Inheritance

Heirs may be deemed to have accepted the inheritance through certain actions. For this reason, if renunciation is being considered, care should be taken with any transactions involving the assets of the deceased.

Disposing of inherited movable or immovable property, making certain debt payments or acting in ways that show the inheritance has been accepted may require a legal assessment.

What Is Deemed Renunciation?

In some cases, if it is obvious that the deceased was insolvent on the date of death, deemed renunciation of the inheritance (mirasın hükmen reddi) may arise.

Deemed renunciation requires a different legal assessment from ordinary renunciation. What matters here is examining the financial situation and debt structure of the deceased at the time of death.

In such cases, it is necessary to act according to the particular facts so that the heirs do not lose their rights.

Renunciation of Inheritance and the Position of the Other Heirs

One heir’s renunciation of the inheritance may also affect the rights of the other heirs. Who the inheritance shares will pass to, the relationships of descendants and the position of the other heirs should be assessed separately.

For this reason, before renouncing an inheritance, the whole inheritance relationship should be assessed, not only the person’s own situation.

Mistakes Made in Renouncing an Inheritance

In practice, one of the most common mistakes made by heirs is assessing the inheritance only in terms of its assets. It should not be forgotten that the inheritance may also include debts.

Another important mistake is missing the three-month period. If the debts of the deceased come to light later, problems regarding the time limit may lead to serious loss of rights.

Renunciation of inheritance is an important legal decision that may affect a person’s financial future. The assets and debts of the deceased, the position of the heirs and the statutory time limits should be assessed together.

Especially with inheritances that carry debts, acting correctly and in time can prevent legal problems the heirs might face later.

Using the Right to Renounce Correctly

Renunciation of inheritance is one of the important rights that heirs have under the law. However, for this right to be used effectively, the process must be conducted in accordance with the legal rules.

Since every case in inheritance relationships has its own particular circumstances, it is important that the decision to renounce an inheritance is made after assessing the specific situation.
