Domain Name Disputes

IT Law

In the online world, domain names have become one of the most important elements of a business’s digital identity. A company’s brand, commercial reputation and digital connection with its customers are often shaped by the domain name it uses. For this reason, the unauthorised use of a domain name, its registration in bad faith or a conflict with trademark rights can lead to significant legal problems.

Domain name (alan adı) disputes are a specific field where intellectual property law and IT law meet, affecting trademark owners, companies, entrepreneurs and people who operate on digital platforms. In these disputes, the question is not only who owns the domain name; the purpose for which it was registered and the rights of the parties are also assessed together.

A domain name is not merely a technical internet address. Today, it has considerable value for businesses in terms of brand awareness, customer access and the continuity of commercial activities.

In particular, when domain names linked to company names, brand names or trade names (ticaret unvanı) are taken by third parties, this can damage the value of the brand and lead to loss of customers and problems with online reputation.

What Is Domain Hijacking (Cybersquatting)?

Cybersquatting, also known as domain hijacking (domain gaspı), is where a person or organisation registers in its own name, in bad faith, a domain name that corresponds to another party’s trademark or has commercial value for another party.

Common examples in practice include:

  • registering the domain name before the trademark owner does,
  • registering domain names with similar spellings,
  • trying to sell the domain name for a high price,
  • using a domain to cause competing businesses to lose customers.

These are among the situations frequently encountered.

Disputes Between Trademark Rights and Domain Names

Trademark registration and domain name registration are separate legal procedures. The fact that a trademark is registered does not mean that the corresponding domain name will automatically belong to the trademark owner in every case. However, trademark rights can provide an important legal basis against domain names registered in bad faith.

In domain name disputes, factors such as trademark rights, history of use, the commercial relationship between the parties and the purpose for which the domain name was registered are assessed.

How Are Domain Name Disputes Resolved?

The route to follow in a domain name dispute may vary depending on the domain extension, the rights of the parties and the nature of the dispute. In some cases administrative dispute resolution procedures may be available, while in others court proceedings may become necessary.

In resolving the dispute, criteria such as the following are important:

  • whether the domain name was obtained in bad faith,
  • whether trademark or commercial rights have been infringed,
  • whether the person using the domain name has a legitimate right to it.

These criteria carry weight in determining the outcome.

What Can Be Done to Recover a Domain Name?

If you believe that a domain name is being used unfairly, the existing legal situation must first be analysed. The appropriate legal method is determined by examining the registration date of the domain name, trademark rights, the way it is used and the parties’ fields of activity.

In some cases, it may be possible to have the domain name transferred, to stop its use or to resolve the dispute through other legal means.

Domain Name Protection Strategies for Companies

For companies operating online, protecting domain names is an important part of brand management. When creating a new brand, considering suitable domain names in good time and making the necessary registrations can prevent disputes that might arise later.

It is also important for companies to consider in advance the legal measures that will protect their trademark rights, digital assets and commercial reputation in connection with the domain names they use.

Although domain disputes may look like a technical registration problem, they are often complex matters that need to be assessed under trademark law, unfair competition (haksız rekabet) rules and IT law.

The same solution is not applied to every domain name dispute. The most appropriate legal route should be determined by examining the purpose for which the domain name is used, the rights of the parties and the available evidence together.
